TERMS OF REFERENCE FOR THE

STATUTORY STAFF DISMISSAL APPEALS COMMITTEE OF

MONKS RISBOROUGH CE PRIMARY SCHOOL GOVERNING BODY



CONSTITUTION:

The Membership of the Committee, and the clerk, will be as per the agreed membership grid.

Please note that the Headteacher cannot clerk a committee.

N.B. The membership of this Committee must be the same size as the Staff Dismissal Committee

The LEA recommends it would not be best practice to appoint a member of staff to this committee.

The Chairman of the Committee will be elected by a quorum of the committee members. A quorum will be at least 3 Governors.


TERMS OF REFERENCE:

1. To hear and determine any appeals against decisions of the Statutory Staff Dismissal Committee in relation to Redundancy, Discipline, Capability (including appeals against dismissal).

2. To ensure that minutes are taken of the meetings and retained in case they are required during any later application to Employment Tribunal (in the case of personnel issues). Meetings must be minuted by someone other than the Headteacher or Governors.

The members of this committee may not be involved in detailed discussion relating to any personnel issues which might possibly eventually result in an appeal.



This Committee was incorporated by Minute No.7 of the School's Governing Body Meeting held on 6TH February 2003. The composition and terms of reference will be reviewed annually in the Autumn Term.
